PARTIES TO DISPUTE:





STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on the Chicago Great Western Railway, that:


(1) the Carrier violated the provisions of the Memorandum of Agreement of July 11, 1939, made by the Carrier with the Brotherhood of Locomotive Engineers, Brotherhood of Locomotive Firemen and Enginemen, Order of Railway Conductors, Brotherhood of Railroad Trainmen, and The Order of Railroad Telegraphers, relating to the use of the telephone by train and/or engine service employes, when it required the conductor-pilot of work extra Y-80 to take train orders over the telephone at Mrkman, Iowa, a station where no telegrapher is employed, on July 28, 29, 30, 31, and August 1, 1941; and that:


(2) the senior, extra telegrapher on the division, idle on each Qf these days, shall be paid a day's pay of eight hours at the minimum .telegrapher rate for each of these days on which he was thus deprived of this work that was his.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held and concluded. Under date of October 13, 1942 the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
