STATEMENT OF CLAIM: (a) That Elmer Daniels, an hourly rated signalman sent from his home station with Signal Gang No. 1, Eastern Division, to perform work of relieving signal maintainer at Turner, Kansas, during the period from October 5 to October 22, 1941, be reimbursed for actual living expenses incurred in the amount of $15.35.


(b) That R. L. Stevens, an hourly rated signalman sent from his home station with Signal Gang No. 1, Eastern Division, to perform work of relieving signal maintainer at Iola, Kansas, during the period from October 22 to October 31, 1941, be reimbursed for actual living expenses incurred in the amount of $10.70.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held and under date of October 28, 1942, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby granted.




Case dismissed.
