BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
(1) That the practice of requiring or permitting others than employes covered by the Brotherhood of Railway Clerks' Agreement to transfer coal and/or other commodities at Salida, Colorado, be discontinued, and
(2) That any or all employes holding seniority rights to the work of transferring coal and/or other commodities at Salida, Colorado, who have suffered monetary loss thru the assigning of this work to others holding no seniority rights thereto, be compensated for such loss, effective from date practice started, which is approximately September 15, 1941. FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and
That no hearing thereon has been held, and under date of December 8, 1942 the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby granted.
