STATEMENT OF CLAIM: Claim of the General Committee of the Order of Railroad Telegraphers on Chesapeake and Ohio Railway, that-
(1) during the period beginning January 14 1941 in which the starting time of the three shifts in the continuously operated telegraph office at Maysville, Kentucky, was changed from 6:00 A. M., 2:00 P. M., and 10:00 P. M., respectively, to 7:00 A. M., 3:00 P. M., and 11:00 P. M., the arriving time of train No. 1 due at Maysville at 6:58 A. M., for which the Third Trick telegrapher, E. N. Reed, whose reassigned hours were 11:00 P. M. to 7:00 A. M., was required to sell tickets, made it impossible for him to check his ticket stock, count his cash, and transfer same to the relieving telegrapher before 7:00 A. M. each day; and that:
(2) overtime necessarily worked each day by Telegrapher Reed after 7:00 A. M., because of this rearrangement of hours, shall be paid for under Rule 29 of the Telegraphers' Agreement. FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the 'third Division of the Adjustment Board jointly by the parties;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and
That hearing thereon has been held but not concluded. Under date of. January 4, 1943, the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
