BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES



STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that Mr. Leroy Abraham, Track Laborer, Section 57, Amos, Los Angeles Division, who was taken out of service at 7:05 A. M. October 26, 1939, and returned to work November 20, 1939, be compensated for net wage loss suffered in the amount of eight hours for each of the working days, October 26 to November 18, inclusive, 1939.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held and concluded. Under date of January 23, 1943 the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
