STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on the Delaware, Lackawanna & Western Railroad that Rule 10 of the Telegraphers' Agreement was violated by the Carrier when in January, 1942, R. A. Beach was disciplined by being held off his regularly assigned position as telegrapher at Owego, New York, without pay for 15 days before he was given the hearing provided for by said rule; that the discipline administered was excessive under the circumstances and that for these reasons Mr. Beach shall be reimbursed for wage loss suffered by him during the 15 days' time he was out of service.
That the dispute was certified to the Third division of the Adjustment Board exparte by complainant party; and
That no hearing thereon has been held and under date of April 5, 1943, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
