PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: 1. Claim of the System Committee of the Brotherhood of Railway Clerks that O. A. Constien be compensated for each Sunday he was denied to work on his position, which work was assigned to extra employes from January 21st, 1936 to March 7th, 1937, which date position was relieved by the regular relief clerk.


2. Claim for time and one-half for all extra employes performing Sunday work on Mr. Constien's position between January 21st, 1937 and March 7th, 1937, date of assignment of regular relief clerk.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third division of the Adjustment Board exparte by complainant party; and


That no hearing thereon has been held and under date of April 5, 1943, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
