PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that the carrier violated the Clerical Agreement:


(1) When on January 16th, 1942 employes covered by the Clerical Agreement were discontinued being used in connection with their duties of Car Markers and such duties were assigned to employes outside of the Clerical Agreement.


(2) That employes Luther L. Bowerman, Lester W. Bungartner, and relief employe James L. Baldwin be compensated each four hours daily at punitive time for each day worked following January 15th up to and including April 5th, 1942, during which period the carrier assigned the duties in conjunction with Car Marker's position to an employe outside the Clerical Agreement.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held, and under date of April 30, 1943, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case Dismissed.
