STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:


(a) The correct rate of pay for the City Ticket Agent at Houston, Texas, is $9.78 per day. Also


(b) Claim that the City Ticket Agent be reimbursed for all losses sustained because of the failure and refusal of the Carrier to apply the correct rate of pay.

FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held, and under date of April 19, 1943 the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.


Case dismissed.
