PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes, that the carrier, the Illinois Terminal Railroad Company, violated and continues to violate the agreement extant between the respective parties, when


(1) It suffered and permitted L. C. Wiedman to hold and to accumulate seniority rights after he left the service of the carrier covered by said clerical agreement, and


(2) That the seniority rights of the said L. C. Wiedman shall not predate his last entry into the service of the carrier that is covered by the clerical agreement, and


(3) That the National Board of Adjustment shall now by an appropriate award and order, direct the carrier to show on the seniority roster, the seniority dating for the said L. C. Wiedman as of the last Gate he entered in the service of the carrier, which service is that covered by the clerical agreement, and


(4) The carrier shall reimburse any and all employes who have suffered any money losses whatsoever by the illegal action of the carrier in retaining the name of the said L. C. Wiedman on the seniority roster as of the date he first entered the clerical service, after he had left that service of the carrier.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of May 6, 1943 the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
