PARTIES TO DISPUTE:





STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on the Atlantic Coast Line Railroad, that Telegrapher J. W. Schultz be restored to his regularly assigned position at Wadesboro, North Carolina, from which he was improperly removed on May 1, 1940, and be restored to the Carrier's service with seniority unimpaired from which he was dismissed on January 31, 1941, and that he be reimbursed for all time he has lost since May 1, 1940.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has ben held, and under date of May 11, 1943, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby granted.




Case dismissed.
