PARTIES TO DISPUTE:





STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on The Pennsylvania Railroad, that when advertisement No. 3 dated April 5, 1941, bulletining leverman at "DAY," Enola, 8:00 P. M. to 4:00 A. M., and advertisement No. 9, dated July 14, 1941, bulletining leverman "DAY," Enola, 9:00 A. M. to 5:00 P. M., were issued, establishing two new positions of leverman on these tricks at "DAY," the carrier was obligated under provisions of Regulations S-C-1, Part 2, of the current agreement, to fix the rate of pay at $.8025 an hour ($.9025 an hour effective December 1, 1941), instead of $.7525 an hour which was established, and that all employes who have occupied these positions since their establishment be retroactively compensated accordingly.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That hearing thereon has been held but not concluded. Under date of May 12, 1943, the parties jointly addressed a formal communication to the Secretary of the Third Division requesting that the claim be withdrawn, which request is hereby granted.




Case dismissed.
