PARTIES TO DISPUTE:





STATEMENT OF CLAIM: Claim of the Joint Council of Dining Car Employes, for and in behalf of Henry Outlaw, waiter, formerly in the service of the Dining Car Department, Alton Railroad Company, that he be returned to his former position of Waiter with seniority restored and compensated for wage loss from January 12, 1942, because of dismissal without just cause.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held and concluded. Under date of May 20, 1943 the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
