BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
STATEMENT OF CLAIM: Claim of the General Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes on the Missouri Pacific Railroad, that the Carrier violated the Clerks' Agreement:
1. When it failed and refused and continued to refuse to compensate Mrs. Clara A. Beckers, Clerk, Payroll Department, Auditor Disbursements' Office, rate $5.75 per day, for the days of September 22, 23, 24, 25, 26 and 28, 1942, while she was absent from duty on account of sickness, in accordance with the provisions of Assistant General Manager's letter of January 11th, 1921, the provisions of Interpretation 2 to Decision 630 of the United States Railroad Labor Board dated at Chicago, Ill. August 4th, 1922, and General Auditor's letter of instructions dated August 16th, 1933, addressed to all department heads of the Accounting Department.
2. That Mrs. Clara A. Beckers shall be compensated for the days stipulated herein at the rate of her position, i.e., $5.75 per day, six (6) days, total $34.50. FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and
That no hearing thereon has been held, and under date of May 20, 1943 the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
