PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES





STATEMENT OF CLAIM: Claim of the General Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes on the Missouri Pacific Railroad, that the Carrier violated the Clerks' Agreement:


1. When it failed and refused and continued to refuse to compensate Mr. V. H. Byrne, Clerk, Machine Bureau, Auditor of Disbursements' Office, rate $6.29 per day, for the days of November 5th, 9th and 10th, 1942, while he was absent from duty on account of sickness, in accordance with the provisions of Assistant General Manager's letter of January 11th, 1921, Interpretation 2 to Decision 630 of the United States Railroad Labor Board dated Chicago, Ill., August 4th, 1922, and the General Auditor's letter of instructions dated August 16th, 1933, addressed to all department heads of the Accounting Department.


2. That Clerk, Mr. V. H. Byrne shall be compensated for each of the days stipulated herein at the rate of his position, that is, $6.29 per day, three (3) days, total $18.87.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of May 20, 1943, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.


Case dismissed.
