BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES


NORTHERN PACIFIC TERMINAL COMPANY OF OREGON

STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes that:


(1) Carrier violated the Clerks' Agreement when on December 8, 1942, it nominally abolished the position of Material and Time Clerk in the Engineering Department and assigned the duties of such position to the Assistant Engineer, Section Foreman and Section Laborer, and


(2) That Patrick DeCristoforo be restored to said position and that he and all other employes adversely affected by carrier's action be reimbursed for all monetary loss sustained retroactive to December 8, 1942.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held, and under date of May 24 1943 the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
