PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that carrier violated the Clerks' Agreement when on August 24, 1942, it discontinued stenographer-clerk position at Union Station, rate $5.64 per day and removed a portion of the duties of that position from the scope and operation of the agreement by assignment to an employe occupying a position wholly excepted from the rules of said agreement, and


That the carrier shall now be required by appropriate award and order of the Board to restore such work as was removed to the scope and operation of the existing wage and working agreement.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That hearing thereon has been held but not concluded. Under date of May 29, 1943, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this dispute, which request is hereby granted.




Case dismissed.
