STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that C. C. Tilson, water service mechanic, Cedar Rapids Division, is entitled to and should receive the difference between that which he earned and received working as a helper and that time which he would have received had he been properly assigned to perform the work making repairs to air compressor and testing air storage tanks at Inver Grove July 6, 1940, and testing air storage tanks at Manly on July 7, 1940, the time work was performed by a maintenance of equipment employe.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held, and under date of June 9, 1943 the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
