BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood of Railway Clerks that the Carrier violated the rules of the Clerks' Agreement when the Carrier blanked Yard Checker positions at Marion, Ohio on assigned relief days, and


That Carrier shall now compensate Employe Sheehe who worked on Sunday, August 4, 1940, August 11, 1940, September 8, 1940, March 23, 1'341, March 30, 1941. Employe Sharrock who worked on Sunday, August 4, 1940, September 8th, September 15th, October 1st, 1940, April 6th, April 20th, 1941. Employe Price who worked on Sunday, January 26th, 1941 and March 16th, 1941. Employe Rank who worked on Sunday, May 4th, June 1st, June 15th and June 29th, 1941, and Employe Marble worked on Sunday, May 25th and July 6th, 1941, at the rate of time and one-half.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of June 18, 1943 the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
