STATEMENT OF CLAIM: Claim of Waiter in Charge, Mr. P. E. Peterson, 4th District, for pay at his regular rate for April 3, 1942 and all subsequent dates that he is held out of service.


OPINION OF BOARD: The evidence of record discloses no grounds for disturbing the action of the Carrier. The Division is of the opinion that Carrier's continuing offer of reinstatement with full seniority rights but without pay for time held out of service should be accepted in disposition of this dispute.


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:


That the carrier and the employe involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That claim be disposed of in accordance with the above Opinion.



Claim disposed of in accordance with above Opinion and Findings.
