PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: Claim of System Committee of the Brotherhood that the work of position of labor foreman at South Sacramento Store is work coming within the scope and operation of the Clerks' Agreement; that the same should have been classified, rated, bulletined and assigned in accordance with the provisions of the Clerks' Agreement and that all employes adversely affected by reason of the Carrier's failure properly to classify, rate, bulletin and assign such Store Department work be reimbursed for all wage losses suffered since October 19, 1937.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held and concluded. Under date of July 16, 1943 the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of the case, which request is hereby granted.




Case dismissed.
