PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:


(a) The carrier violated rules of our current agreement when it failed to permit Mr. Walter H. Hoppe to exercise right of displacement at Tucson, Arizona, June 3, 1942, and


(b) Mr. Hoppe be compensated for the day lost at the rate of the position on which he should have been allowed to displace, i. e., General Clerk, $6.77 per day.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of July 28, 1943, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
