PARTIES TO DISPUTE:

BROTHERHOOD .OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: It is the claim of the System Committee of the Brotherhood that:


(a) The carrier violated the rules of our current agreement when it failed to inform Mr. W. A. Swain, Tucson, Arizona, of change in day of rest on his assigned position of Caller, rate $6.50 per day, which position he had acquired by bulletin assignment, and thereby caused him to lose one day's pay, May 27, 1942.


(b) That Mr. W. A. Swain be compensated for the day thus lost in amount of the rate of the position, i.e., $5.50 per day.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of July 28, 1943, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
