PARTIES TO DISPUTE:

BROTHERHOOD OF' RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:


(a) The Carrier violated and continues to violate the rules of the Clerks' Agreement when it declined and continues to decline to compensate Mr. Fred Melin Head Government Bill of Lading Clerk, Oakland, Kirkham Street Freight Station, at rate of $7.54 for each day worked during the period February 16, 142, to and including November 30, 1942.


(b) Mr. Fred Melin be compensated at rate of $7.54 per day, less compensation already received, for each day worked during the period February 76, 1942, to and including November 30, 1942.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of July 28, 1943, the complainant party addressed a forml communication to the Secretary of the Third Division requesting withdrawal of this case, which request, is hereby granted.




Case dismissed.
