BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:
(a) The carrier has violated and continues to violate rulhs of the Clerks' Agreement when it declined and continues to decline to compensate Mr. Charles Worrell, Yardmen's Timekeeper, Los Angeles, California, at the established rate for that position for the period September 11, 1939, to and including March 31, 1942.
(b) Mr. Worrell be compensated at rate of $6.24 per day for period September 11 1939, to and including August 31, 1941; $6.96 per day September 1, 1941, to and including November 31, 1941, and at rate of $7.04 per day December 1, 1941, to and including March 31, 1942.
Note: In explanation of the different rates of pay shown in Item (b) above, the Board will please understand there was granted by mediation an increase of nine (9) cents per hour, effective September 1, 1941, and an additional one (1) cent, or a total of ten (10) cents per hour effective December 1, 1941.
That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and
That no hearing thereon has been held, and under date of August 5, 1943, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
