PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: Claim of the General Committee, Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes on the Baltimore and Ohio Railroad,-New York Terminal Region that the carrier violated the agreement in refusing to permit Charles Spanier to work according to his seniority on March 1, 1940.


1. Charles Spanier be allowed one day's pay at Tallyman's rate for March 1, 1940.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board jointly by the parties;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That no hearing hereon has been held, and under date of August 11, 1943, the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of the case, which request is hereby granted.




Case dismissed.
