PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES






STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks that:


(1) The terms of both the Clerks' Agreement of November 15, 1926 and the National Vacation Agreement of December 17, 1941, have been violated, and that, therefore,


(2) Clerk S. I. Carlton, Albany, Ga., shall now be compensated for two hours at straight time rate and five hours at penalty rate each day for the period from August 4, 1942 to August 15, 1942 inclusive, or 24 hours prorata rate and 60 hours penalty rate, representing 12 days' time worked to allow Clerk W. E. Hayslip vacation.

FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held, and under date of August 12, 1943, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
