PARTIES TO DISPUTE:





STATEMENT OF CLAIM: (1) Claim of the General Committee of The Order of Railroad Telegraphers on The Pennsylvania Railroad, that Operator L. D. Kerr is entitled to time and one-half when he performed a second tour of duty as telegrapher in "A" Office, Erie, Pa., on March 16, April 9 and 11, 1942, respectively, under provisions of Regulation 4-C-1 of the Telegraphers' Agreement.


(2) Claim of the General Committee of The Order of Railroad Teleg raphers on the Pennsylvania Railroad, that Operator Thomas Eddy is entitled to time and one-half when he performed a second tour of duty as telegrapher and printer-operator in "A" Office, Erie, Pa., on April 7 and 9, 1942, respectively, under the provisions of Regulation 4-C-1 of the Telegraphers' Agreement.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held, and under date of October 4, 1943, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
