STATEMENT OF CLAIM: (a) Request that the twenty demerits be removed from the personal service record of Mr. B. C. Wicen, Signal Maintainer, which were assessed him on January 5, 1943, for his alleged responsibility in connection with signal failure on December 20, 1942.


(b) Claim of B. C. Wicen for compensation for eight days, eight hours each day, at the rate of 95 cents per hour for time lost December 22 to 31, 1942, inclusive, except December 25 and 27, account of being held from service by the carrier.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party:


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held but not concluded. Under date of October 6, 1943, the petitioner addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
