PARTIES TO DISPUTE:

BROTHERHOOD OF RAILROAD SIGNALMEN OF AMERICA

DENVER & RIO GRANDE WESTERN RAILROAD COMPANY

STATEMENT OF CLAIM: (a) Protest against the assignment of the position of signal maintainer at Grand Junction, Colorado, to Mr. R. F. Holmberg, Signal Supervisor, on February 21, 1942.


(b) Claim that the position of signal maintainer at Grand Junction, Colorado, advertised on Bulletin No. 156, posted February 9, 1942, should have been awarded to the senior employe covered by the Scope of the agreement making application for it and that he be allowed the difference, if any, in salary earned and the salary he would have earned had he been assigned the position, plus any expenses incurred by him while being denied the position.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held and under date of October 19, 1943, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby granted.




Case dismissed.
