PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: Claim of the Terminal Committee of the Brotherhood that the Carrier violated the Agreement between the parties hereto when it failed and refused to apply such agreement properly and as a result of said violation Jos. Fretschel, Emil Theiston and other employes were not properly compensated and shall now be paid the difference between what they were paid at straight time and time and one-half for all time worked in excess of eight (3) hours on any day since May 15, 1942.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held, and under date of October 14, 1943, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
