STATEMENT OF CLAIM: Claim of the System Committee of the
Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express
and Station Employes on the Chicago, Rock Island and Pacific Railway
Company that:
1. Mr. Jess Garwick, Mail Handler, Des Moines, Iowa, rate $150.70
per month, assigned hours 11:30 P. M. to 8:00 A. M., 30 minutes
for lunch, be reimbursed for time held out of service February
11, 1943 to May 11, 1943 inclusive, and
2. That Mr. Jess Garwik be allowed expenses incurred account these
charges as follows: Attorney fees $100.00 and Bond cost $50.00,
money he was forced to pay out.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by complainant party; and
That no hearing thereon has been held, and under date of November 18,
1943, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request
is hereby granted.
Case dismissed,
