PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES



STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:

(a) Carrier violated and continues to violate schedule for clerks effective August 1, 1929, by requiring and permitting telegraph operators employed at East Switch yard office, Council Bluffs, Iowa, to perform clerical work not incidental to or in consequence of their classified duties as covered by the Telegraphers' schedule, also permitting General Yardmaster-Agent W. M. R. Ketcham, to perform clerical work not incidental to or in consequence of his position.


(b) Clerical duties performed by telegraph operators at East Switch yard office be restored under schedule for clerks, also clerical duties performed by General Yardmaster-Agent.


(c) Clerical assignment or assignments necessary to handle yard clerk duties now performed by telegraph operators at East Switch yard office, also clerical duties performed by General YardmasterAgent, be established with daily rate of pay in keeping with established rate for yard clerk positions formerly in existence at East Switch yard office, which rate would now be $5.93 per day.


(d) Successful applicant or applicants be compensated for any monetary loss sustained account of Telegraphers and General Yardmaster-Agent performing work covered by the schedule for clerks, retroactive to July 8, 1939, date of General Chairman Rogers' letter to Mr. G. H. Sido, Chief Operating Officer, setting forth definite position of Clerks' committee.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and

That no hearing thereon has been held and under date of December 29, 1943 the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing the case, which request is hereby granted.
AWARD Case dismissed.
