PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES



STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:

(a) Carrier violated and continues to violate schedule for clerks effective August 1, 1929 by requiring and permitting Local Agent and Telegraphers employed at Logansport, Indiana, to perform clerical work which is covered by the schedule for clerks.


(b) Clerical work covered by the schedule for clerks, checking of yards and incidental yard clerk duties, freight office clerical duties be restored under the schedule for clerks and assigned to a clerical employe.


(c) Necessary clerical assignment be established at Logansport, Indiana, with daily rate of pay to conform to prevailing rate paid for similar class and kind of work performed at Logansport station, or on the Montpelier Division seniority district. The successful applicant to be compensated for any monetary loss suffered, retroactive to July 1, 1942, account of Local Agent and Telegraphers performing clerical duties which are not incident to or in consequence of their positions.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment
Board ex parts by complainant party; and

That no hearing thereon has been held and under date of December 29, 1943 the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing the case, which request is hereby granted.



Case dismissed.
