PARTIES TO DISPUTE:





STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on The Pennsylvania Railroad, that BlockOperator C. H. Smith, required to work March 24th and 31st, 1942, the seventh consecutive work days on the second trick at "HG" Langdon, is entitled to time and one-half under the provisions of Regulation 4-B-4 of the Telegraphers' Agreement, Part 2, for working the seventh day which the Carrier was obligated to assign as his relief day.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of February 7, 1944, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby granted.




Claim dismissed.
