STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that


(1) The carrier violated and continues to violate the Clerks' Agreement when, effective December 1, 1941, it transferred Mr. Theo. A. Same, ClerkSteno in the City Passenger Agent's Office, Syracuse, N. Y., together with his rate $125.00 per month (present rate $155.60 per month) to position of Steno-Clerk, rate $152.60 per month (present rate $183.10 per month) then vacant in the Division Freight Agent's Office at the same point, and


(2) That Same be allowed the rate attaching to the position occupied $183.10 per month and paid the difference between that rate and the rate he has received $155.60 per month retroactive to December 1, 1941.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held, and under date of February 4, 1944, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Claim dismissed.
