PARTIES TO DISPUTE:





STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on the Northwestern Pacific Railroad Company that the Agent at Dos Rios (a one-man station) be compensated on the basis of one call as provided in Rule 6, plus commissions on milk and cream as provided for in the Milk and Cream Agreement in effect on the Northwestern Pacific Railroad Company between that Carrier and this Organization, for each day during the period May 1, 1939, to September 19, 1939, that, during the time of day when the agent was off duty, the handling of milk and cream from station platform to train-a duty which is regularly assigned to and performed by the agent when on duty-was delegated to parties outside the Scope rule of the Telegraphers' Agreement.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of February 25, 1944, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby granted.




Claim dismissed.
