PARTIES TO DISPUTE:





STATEMENT OF CLAIM: "* * * for and in behalf of J. R. Watson who was formerly employed by The Pullman Company as a porter operating out of the district of Philadelphia, Pennsylvania. Because The Pullman Company did, under date of September 11, 1942, discharge Mr. Watson from his position as a porter in the Philadelphia district on charges unproved; which penalty, because of its severity, was unjust, unreasonable and in abuse of the company's discretion. And further, for Mr. J: R. Watson to be returned to the service with his seniority unimpaired and with pay for all time lost because of this unjust and unreasonable disciplinary action."


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board exparte by complainant party; and


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held and concluded. Under date of February 22, 1944, the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this dispute, which request is hereby granted.




Case dismissed.
