BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: Claim of System Committee of Brotherhood that:


1-The Carrier violated Rules 22 and 23 of the Clerks' Agreement when on December 4, 1942, they dismissed from the service, Charlie Carthern, Porter, Augusta Union Station Company, Augusta, Ga.


2-Porter, Charlie Carthern be reinstated to his former position without prejudice to his seniority and compensated for all time lost since his arbitrary removal at a salary of $3.68 per day retroactive to date of dismissal.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held but not concluded. Under dates of March 11, 1944, and March 20, 1944, the Carrier and the Employes, respectively, addressed formal communications to the Secretary of the hird Division withdrawing this case, which request is hereby granted.




Claim dismissed.
