PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: (1) Claim of the System Committee of the Brotherhood that the Carrier violated its agreement with the Brotherhood when after it temporarily assigned various employes to positions in the Mail and Baggage Department, it refused to compensate them for such service in accordance with the provisions of Rule 49 of the agreement, and


(2) That the Carrier shall now be required to compensate all employes listed in Exhibit "A" attached hereto and made a part hereof, for the hours on dates shown thereon at the rate of pay of position to which they are


regularly assigned as indicated, together with all additional time subsequent thereto and continuing until such time as the violation has been corrected, and


(3) That the Carrier shall now be required to compensate all other employes not listed in Exhibit "A" for similar service, effective as of October 8, 1943, in like manner and to the same extent as indicated in Item 2, above, same to continue until such time as the violation has been corrected.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held but not concluded. Under date of April 5, 1944 the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
