STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that W. Guernsey, M. Cannastra, Lynn Thompson and Michael Falzarano be allowed two (2) hours' pay at the straight time rate and onehalf (%) hour's pay at the overtime rate based on the Car Repairers' rate of 86¢ per hour for work performed between the hours of 12:00 noon and 2:30 P. M. on October 6, 1941, at Howes Cave, in re-railing B. & O. car No. 323768.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of April 22, 1944, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby granted.




Claim dismissed.
