PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:


(a) The Carrier violated the Clerks' Agreement at Corpus Christi, Texas, on October 31, 1943, when it abolished the positions of Chief Clerk, rate $230.40 per month, and Assistant Chief Clerk, rate $195.40 per month, and concurrently therewith created in lieu thereof positions of Rate Clerk, rate $220.40 per month, and General Clerk, rate $170.40 per month. Also


(b) The Carrier further violated the Clerks' Agreement at Corpus Christi, Texas, when, effective November 1, 1943, it assigned to the position of Yard Clerk, rate $133.58 per month, certain work which had theretofore been assigned to and performed by the Assistant Chief Clerk at a rate of $195.40 per month. Also


(c) Claim that the position now designated as Rate Clerk be paid at rate of $230.40 per month and that positions designated as General Clerk and Yard Clerk be paid at rate of $195.40 per month, retroactive to November 1, 1943.

(The above rates do not include recent general wage increases.)
FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing has been held thereon, and under date of April 29, 1944, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.


Case dismissed.
