STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:


(a) The Carrier violated the Clerks' Agreement at Laredo, Texas, May 17 to 22, 1943, inclusive, by having interchange reports compiled by Traveling Car Agents Wright and Coleman, employed in Seniority Districts Nos. 16 and 18, respectively. Also


(b) Claim that the employe or employes regularly assigned to the work of compiling interchange reports be compensated at the rate of time and onehalf for all time spent by Messrs. Wright and Coleman compiling interchange reports.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held, and under date of April 29, 1944 the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
