BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES



STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that Mr. O. J. Stembel, B. & B. mechanic who was deprived of an opportunity to work on July 6, 1943 be paid 11% hours for that day at his regular hourly rate, S hours at pro rata rate and 3%a hours at time and onehalf rate.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of May 9th, 1944, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby granted.




Case dismissed.
