PARTIES TO DISPUTE:





STATEMENT OF CLAIM: Claim of the General Committee, The Order of Railroad Telegraphers on the Kansas City Southern Railway, that J. N. Jones, the senior bidder on the position of agent at DeRidder, Louisiana, advertised on June 14, 1943, be awarded the position and granted a fair and impartial trial thereon and if found competent, shall be reimbursed for the difference in the rate of pay of his present position and that of the agency position since June 24, 1943, the date of assignment of the junior employe.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held, and under date of May 23rd, 1944, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby granted.




Case dismissed.
