PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:


(a) Carrier violated the rules of the Schedule for Clerks effective August 1, 1929, in assigning and requiring the occupants of two positions designated as Callers, to perform duties of similar class and kind to those assigned to and performed by the occupant of a clerical assignment of Crew Dispatcher, and compensating the occupants of the two Caller positions at Callers' rate of pay.


(b) Two positions designated as Callers, located in office of Roundhouse Foreman and Road Foreman of Engines at Peru, Indiana, be re-classified as Crew Dispatcher Clerks; the two positions to be bulletined as Crew Dispatcher Clerks with an established daily rate to conform to the daily rate established for a position of similar class and kind in the office, which position is assigned daily from 8:00 A. M. to 4:00 P. M., seven days per week.


(c) The occupants of the two positions designated as Callers to be compensated for daily difference in the established basic rate of Caller and the established basic daily rate of Crew Dispatcher Clerk, which is $1.5834 per day, as of October 1, 1942, date on which the matter was referred to the Division Superintendent at Montpelier, Ohio, for adjustment.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of May 26, 1944, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
