THE ORDER OF RAILWAY CONDUCTORS,

PULLMAN SYSTEM




STATEMENT OF CLAIM: 1. That The Pullman Company violated Rule 31 of the Conductors' Agreement when it refused to assign Conductor Ilot Johnson, Los Angeles District, to Santa Fe Trains No. 23 and No. 24, on the basis of seniority, when the assignment in question-known as the Grand Canyon Limited-was rebulletined following the annulment of the run due to high water; and


2. That Conductor Johnson be reimbursed for any monetary loss suffered as a result of the Carrier's refusal to allow him to depart from Los Angeles in the assignment on February 10, 1943, when on the basis of seniority he was entitled to depart.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held but not concluded and under date of July 6, 1944, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of the case, which request is hereby granted.




Case dismissed.
