PARTIES TO DISPUTE:





STATEMENT OF CLAIM: The Order of Railway Conductors, Pullman System, claims that The Pullman Company violated Rules 38 and 39 of the Conductors' Agreement-


(1) when, during the month of October, 1942, it failed properly to prorate the time of the extra conductors in the Chicago Western District, thereby causing Conductor J. A. Moody to lose time; and


(2) that Rules 38 and 39 shall now be properly applied and Conductor Moody be compensated for all monetary loss sustained by reason of the violation.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held and under date of July 6, 1944, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby granted.




Claim dismissed.
