PARTIES TO DISPUTE:





STATEMENT OF CLAIM: Conductor R. L. Janes, Jacksonville District, is claiming pay for 13:15 hours' station duty performed on October 1st and 9th, 1943-for which he was first paid $12.96, this amount later being deducted from his pay for second half of October; also claiming pay for performing station duty from 1:35 A. M. October 16th until 7:15 A. M. same date-5:40 hours, and from 1:20 A. M. October 24th until 7:15 A. M. same date-5:55 hours; total time claimed 24:50 hours.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held and under date of July 5, 1944, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby granted.




Claim dismissed.
