PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND 'STATION EMPLOYES




STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:


(a) Carrier violated the rules of Clerks' Agreement when it cancelled on April 11th, position of General Clerk, advertised for seniority choice on Clerks' Bulletin No. 132, dated April 6, 1942, and established in lieu thereof, a position of Telegrapher-Clerk at Eureka, California.


(b) Position of General Clerk be established at Eureka, California and bulletined for seniority choice of employes coming within scope of Clerks' Agreement.


(c) All employes coming within scope of Clerks' Agreement, adversely affected by establishment of position of Telegrapher-Clerk, on or about May 11, 1942, be reimbursed for any wage loss suffered.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party:


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held but not concluded. Under date of July 31, 1944 the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
